Police Prioritize Restorative Justice in Solving Cases in The Society

inp.polri.go.id – Restorative justice is currently a priority for the police in resolving minor cases. So that not all cases end up in court with imprisonment. This is in accordance with the principle of always prioritizing the restoration of all conditions and restoring the good relations in society.

Due to the settlement of cases using a restorative justice approach, currently 1,052 Sectoral Police in 343 Departmental Police are no longer conducting the investigation process.

Head of the Criminal Investigation Agency (Kabareskrim) of the Indonesian National Police (Polri), Commissioner General Agus Andrianto in his statement, Tuesday (19/4/2022), said that the National Police Chief (Kapolri) General Listyo Sigit Prabowo emphasized to investigators that criminal law is the last resort in law enforcement (Ultimate Remidium). Agus said that the National Police (Polri) must be able to position itself as an institution that provides a sense of justice to the community.

However, Agus emphasized that not all cases can be resolved using a restorative justice approach, as stated in Article 5 of the National Police Chief Regulation (Perpol) Number 8 of 2021, in which cases can be resolved through restorative justice must meet material requirements.

Crimes that cannot be resolved with restorative justice include terrorism, crimes against state security, corruption, and cases against people’s lives. This restorative justice also should not cause unrest and/or rejection from the community, do not have an impact on social conflict, do not have the potential to divide the nation, not indicate radicalism and separatism, and not repeat criminal acts based on court decisions.

If these conditions are met, then the Police will favor the restorative justice approach.
